BH BOUTIQUES
RETURN & EXCHANGE POLICY (ALL SALES FINAL)
This policy applies to all purchases from BH Boutiques at bhboutiques.com and through the BH Boutiques app for iOS and Android. We ship only within the United States, and all prices are in U.S. dollars.
PLEASE READ BEFORE YOU PURCHASE
ALL SALES ARE FINAL. BH BOUTIQUES DOES NOT ACCEPT RETURNS AND DOES NOT ISSUE REFUNDS FOR CHANGE OF MIND. QUALIFYING ITEMS MAY BE EXCHANGED AS DESCRIBED BELOW. GENUINE DEFECTS AND ITEMS DAMAGED IN SHIPPING ARE ALWAYS TAKEN CARE OF, AND NOTHING IN THIS POLICY LIMITS ANY RIGHT THAT CALIFORNIA LAW — OR ANY OTHER LAW THAT APPLIES TO YOUR PURCHASE — DOES NOT ALLOW TO BE WAIVED.
Key timeframes: exchange requests must be made within 7 days of delivery, and we ask you to report shipping damage within 48 hours of delivery. Neither window limits any right the law gives you for a piece that is defective or was not what you ordered. Full details are below.
California Civil Code Section 1723 requires a store that does not offer refunds to make that policy clear and conspicuous before you buy. This notice, together with the ALL SALES FINAL notice shown on our product pages and in your cart before you check out, is provided as that disclosure. We would rather you know how we work before you fall in love with a piece.
1. WHY EVERY SALE IS FINAL
BH Boutiques is a true boutique. Our women's and men's clothing, jewelry, and antiques are mostly one-of-a-kind pieces. When a piece sells, we usually cannot restock it, and once it has traveled out and back it can rarely be offered again as it was. A traditional return-and-refund model simply does not fit what we sell. Instead, we put our energy into two things: carefully checking each piece against its listing before it ships, and standing behind you — with the exchange process in Section 3 and the protections in Sections 5 and 6 — when something genuinely goes wrong.
2. HOW WE PREPARE EVERY ORDER
Before an order leaves us, our practice is to:
- Inspect each piece multiple times.
- Photograph each piece, so its condition at packing is documented.
- Pack each piece carefully for safe transit.
Careful preparation is how we look after each piece and each customer. It is not a guarantee that nothing can ever go wrong — and when something does, Sections 3, 5, and 6 explain exactly how we handle it. The photographs and inspection notes simply give both of us a clear, fair record to work from if a question ever comes up.
3. EXCHANGES: WHEN SOMETHING GENUINELY GOES WRONG
We do not offer exchanges for change of mind, but we do offer them when something is genuinely wrong with the piece you received. An issue qualifies for an exchange when:
- You received the wrong item.
- The piece does not match its listing photos, its description, or its stated measurements on our site or app.
- The piece has a condition problem that was not disclosed in the listing.
(Shipping damage and defects are handled in Sections 5 and 6.)
Exchange requirements:
- Request your exchange within 7 days of delivery — the carrier's confirmed delivery date or, if later, the day you actually received the piece.
- The piece must be in the same condition you received it, apart from the issue you are reporting, with any original tags still attached where applicable. (Some jewelry and antique pieces ship without tags; "where applicable" means exactly that.) Normal handling to inspect or try a piece does not disqualify you, and this condition requirement never applies to defect claims under Section 6.
- Exchange requests are verified. We review every request in good faith against the listing and the pre-shipment photographs of your exact piece. Those records are evidence, not a verdict: they are never conclusive against you, and we will always consider what you show us, including problems that only become apparent once a piece is worn or used. Verification is about confirming the facts, and it never limits any right the law gives you. If we decline a request, we will tell you why in writing.
One thing the 7-day window is not: a limit on your legal rights. It is how our voluntary exchange program works. It does not shorten or limit any right California law gives you when a piece is defective or materially not as described — those situations are covered in Section 6, which has no 7-day deadline.
How to start an exchange:
- Email info@bhboutiques.com with the subject line "Exchange Request" and your order number.
- Tell us what the issue is and attach clear photos showing it.
- We will review your request and reply with a decision and next steps. Please do not ship anything back until we confirm; we can only accept items we have authorized in advance.
Because our pieces are one of a kind, an identical replacement usually does not exist. An approved exchange can be fulfilled as an exchange for another piece or as store credit. Store credit equals the full amount you paid for the item, including its sales tax; if the issue was our error, it also includes what you paid for shipping on the original order. If the piece you choose costs more than your credit, you pay the difference at checkout; if it costs less, the remainder stays on your store credit. Store credit does not expire, and as California law provides, store credit balances under ten dollars are redeemable for cash on request.
And if we sent the wrong item, or a piece was materially not as described, and we cannot provide the piece you actually ordered, you may choose a full refund to your original payment method instead of an exchange or store credit.
4. EXCHANGE SHIPPING
- Once your exchange is approved, we will email you the return address and full instructions.
- If the issue was our error — for example, we shipped the wrong item, or the piece was materially not as described — we will email you a prepaid return label, the return shipment is our responsibility from the moment the carrier accepts it, and we will ship your exchange piece to you at no charge.
- For other approved exchanges, you cover the cost of shipping the item to us, and we cover the cost of shipping your exchange piece to you. Please use a tracked shipping service and pack the item securely, ideally in its original packaging; for these exchanges, the item remains your responsibility until it reaches us. We will confirm the exact arrangements in your authorization email before you send anything.
- We ship only within the United States, so exchange shipments must be sent from and delivered to a U.S. address.
5. DAMAGED IN SHIPPING: PLEASE TELL US WITHIN 48 HOURS
Our practice is to inspect each piece multiple times, photograph it, and pack it carefully before it ships (Section 2), so if a piece arrives damaged, the damage most likely happened in transit. We handle transit damage as a shipping-damage claim, separate from the exchange process and at no cost to you.
- Please report the damage within 48 hours of delivery by emailing info@bhboutiques.com with your order number. Prompt reports with clear photos are what make carrier claims succeed — that is why we ask for 48 hours.
- Include clear photos of BOTH the damaged item AND all of the packaging, inside and out: the shipping box, padding, and wrapping.
- Keep the item and all packaging until your claim is resolved; the carrier may need them for inspection.
We file and manage the carrier claim ourselves, and we resolve the damage with you directly rather than making you wait on the carrier's decision. Occasionally a carrier needs to inspect the item and packaging where they were delivered; if that happens, we will coordinate it with you. Depending on the piece and the situation, we will make it right with a repair, an exchange or a replacement piece of comparable value where one exists, store credit, or, where the law entitles you to one or we cannot otherwise resolve the issue, a refund to your original payment method.
A later report never eliminates your rights. If you discover damage after the 48-hour window, or something kept you from inspecting your delivery in time, contact us as soon as you can anyway: a piece that arrived damaged is treated as a defect under Section 6 and under California law, and we will still work with you toward a fair resolution — though delay may limit what we can recover from the carrier.
6. GENUINE DEFECTS: ALWAYS TAKEN CARE OF
Let us say this plainly: if a piece you bought from us turns out to be genuinely defective, we will take care of it. Always. "All sales final" applies to change of mind. It does not, and legally cannot, apply to defects.
Under the Song-Beverly Consumer Warranty Act (California Civil Code Section 1790 and following), consumer goods carry an implied warranty of merchantability that a retailer cannot disclaim through a final-sale policy, and we do not attempt to. Nothing in this policy waives, limits, or conditions any right or remedy you have under the Song-Beverly Consumer Warranty Act or any other consumer protection law that applies to your purchase.
If you believe your piece is defective, email info@bhboutiques.com with your order number, a description of the problem, and photos. There is no 7-day or 48-hour deadline on this section. We verify defect reports the same way we verify exchanges — in good faith, with our records treated as evidence rather than a verdict — and verification never limits any right the law gives you. Once the defect is confirmed, we will make it right with a repair, an exchange or a replacement piece of comparable value where one exists, store credit, or, where the law entitles you to one or we cannot otherwise resolve the issue, a refund to your original payment method. That includes a refund where the Song-Beverly Act entitles you to one. We will work the remedy out with you based on the piece and the nature of the problem.
A piece that arrived damaged in transit and could not be reported within the 48-hour window in Section 5 is handled under this section.
One note for antiques and vintage pieces: age-related wear, patina, and other characteristics that are described in the listing or visible in the listing photos are part of the piece's history, not defects. A defect is a problem beyond the condition we described and showed you.
7. WHAT THIS POLICY DOES NOT COVER
To keep everything above honest and clear, here is what does not qualify for an exchange or claim:
- Change of mind, including "it doesn't suit me," "I found something else," or no longer wanting the piece.
- Fit or size preference when the item matches its published size chart and listed measurements. We are always happy to answer sizing and fit questions at info@bhboutiques.com before you buy.
- Ordinary wear and tear after delivery, or damage caused by use, alteration, or improper care after delivery.
- Exchange requests made after the 7-day exchange window, for issues that are not defects.
Two important limits on these exclusions. None of them applies to a genuine defect, which is always covered under Section 6 with no 7-day deadline. And none of them limits any right the law gives you: the 7-day window is how our voluntary exchange program works, and shipping damage discovered late is handled under Sections 5 and 6.
8. BILLING QUESTIONS AND CARD DISPUTES: TALK TO US FIRST
All payments are processed through Shopify's secure hosted checkout (including Shop Pay, Apple Pay, and Google Pay), and your card details never touch our own systems.
If a charge looks wrong, or you have any billing or order concern, we ask that you contact us first at info@bhboutiques.com and give us the chance to fix it — billing issues are almost always fastest to resolve directly with us. In our experience, an email to us resolves most billing issues within a few days, while a formal card dispute typically takes weeks. This is about sequence, not a limit on your rights: nothing in this policy waives or conditions any right you have under the Fair Credit Billing Act or your card agreement, and you should never delay past a deadline your card issuer sets. Your dispute rights come first.
A word on documentation, in fairness to everyone: for every order, we keep the inspection records, the pre-shipment photographs of the exact piece, the tracking history, and the carrier's delivery confirmation. If a payment dispute is filed for an order our records show was delivered as described, we will respond to the dispute and provide that documentation to the card networks. We would much rather solve the problem with you directly, and we almost always can.
9. GOVERNING LAW AND HOW DISPUTES ARE RESOLVED
This policy, and any purchase from BH Boutiques, is governed by the laws of the State of California, without regard to conflict-of-law rules. This policy is intended to comply with the Consumers Legal Remedies Act (California Civil Code Section 1750 and following) and all other applicable consumer protection law, and it should be read that way: nothing in it takes away any right that California law — or the law of your home state, to the extent it applies to your purchase despite this choice of law — does not allow to be waived.
Step one: talk to us. Before starting any formal legal proceeding, email info@bhboutiques.com with your order number and a description of the issue. We will work with you in good faith to resolve it informally for at least 30 days from the date your email is received. This step is about legal proceedings only: billing questions and card disputes are covered in Section 8, and nothing in this section delays or limits any right you have with your card issuer.
Step two: the dispute resolution terms in our Terms of Service. If we have not resolved the issue within that 30-day window, the dispute is resolved as set out in Section 12 of our Terms of Service, which applies to every purchase and is the single controlling dispute resolution text; if this summary and Section 12 ever differ, Section 12 governs. In plain language, Section 12 provides for final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted on an individual basis, with BH Boutiques paying all AAA filing, administration, and arbitrator fees beyond your initial filing fee, as those rules provide — and it preserves the rights California law protects:
- Small claims court stays open. Either of us may bring a qualifying claim in small claims court instead of arbitration, including the small claims court where you live if your claim qualifies there.
- Public injunctive relief stays open, as California law requires (McGill v. Citibank).
- Disputes are individual. Neither of us may participate in a class, collective, or representative action against the other.
- You can opt out. You may opt out of arbitration entirely, with no effect on any other part of this policy or your purchase, by emailing info@bhboutiques.com within 30 days after your first purchase. No particular subject line or format is required — just tell us who you are and that you are opting out.
The AAA's consumer rules also set any in-person hearing at a location reasonably convenient to you. If any part of this policy is found unenforceable, the rest of this policy remains in effect.
10. QUESTIONS BEFORE YOU BUY
The best exchange is the one you never need. If you are unsure about sizing, measurements, materials, condition, or anything else about a piece, email us before you order. We answer honestly, and we would rather answer ten questions than have one disappointed customer.
